Development and use of artificial intelligence in light of the negative and positive obligations of the state to guarantee the right to life

The right to life is a universally recognized fundamental human right, and its provision is a precondition that warrants for all other human rights. The development and use of artificial intelligence (AI) can affect the right to life both negatively and positively. 

Use of AI by States may lead to a breach of their negative obligation to respect the right to life, which could occur for instance during the use of autonomous weapons systems that are being led by AI or in the development of databases for health, transport, regulatory or other purposes, in view of the negative obligation of States to respect the right to life. AI, however, can also be used to fulfil the positive obligations of States to guarantee the right to life, as for instance in preventing environmental pollution, deadly diseases, hunger and poverty. 

This project will conduct research and analyses, as well as determine the main concepts on development and use of AI technology in line with the obligation to guarantee the right to life both in terms of negative and positive obligations of States. 

The main objective is to offer an in-depth scientific research on the interactions between the development and use of AI on the one hand, and the right to life on the other hand, which will contribute to the development of the current state of science, promote further research and provide a basis for normative regulation of permitted and prohibited use of AI, thereby serving as a guide in making concrete decisions on the further development and use of AI and thus contributing to providing assurance of the right to life in practice.
