    The Potential Use of Legitimate Force for the Preservation of Order: Defining the Inherent Role of Public Police Through Policing Functions that cannot be Carried out by Private Police

    Synopsis:
    In the UK, private policing institutions have been rapidly increasing since the 1980s, so the lines between public- and private police have been blurred. This paper explores whether there is a policing function that is inherent in public police and if so, why it occupies this position. It integrates Rousseau’s social contract theory, Bittner’s definition of police functions, Brodeur’s reasoning on force and Loader and Walker’s concept of ‘policing as public good’ to argue that the potential use of legitimate force for the preservation of order is the function intrinsic to public police. It shows why it cannot and should not be carried out by private police and outlines how it depends on police legitimacy. It concludes with an abstract rethinking of public-state-police relations to determine that this function remains in the realm of public policing.

    Right to Self-Defence against Non-State Actors in the Context of Fight against Terrorism

    Pravica do samoobrambe zoper nedržavne akterje v luči boja proti terorizmu


    Synopsis:
    The use of force in self-defence against non-state actors in the territory of another state not having effective control over activities of non-state actors is subject of numerous controversies. While the traditional approach limits the use of force in self-defence from Article 51 of the UN Charter to the inter-state relations, the ever-present threat of international terrorism triggered new trends in expanding the notion of self-defence to private armed attacks. In the past, countries justified their use of force against non-state actors on the territory of another state by attributing the attack to the host state. However, in the last few years, especially in the context of fight against ISIL in Syria, an unwilling or unable host state doctrine received an unprecedented attention. The authors of the paper present prevailing legal arguments for the use of force against non-state actors and assess whether a wider understanding of Article 51 of the UN Charter has emerged.

    Challenges of Alternative Dispute Resolution in Administrative Relations in a Slovenian and Wider Context

    Izzivi alternativnega reševanja sporov v upravnih razmerjih v Sloveniji in širše


    Synopsis:
    Considering that in administrative relations, particularly in individual administrative matters, administrative bodies strictly adhere to the law and primarily protect the public interest, alternative dispute resolution (ADR) is yet being gradually introduced into the relevant legal system and practice. Yet, despite the limitations relating to its application in administrative relations, certain forms of ADR indeed bring advantages, such as faster and more efficient procedures, increasing satisfaction of participants and faster adoption of decisions (even if unfavourable), less burdens for appellate and sanctioning bodies and courts, a more creative role of the administration, etc. By examining the evolution of ADR in general, the recommendations of the Council of Europe and the EU, and selected foreign regulations, the paper analyses the specifics of administrative relations as regards the use of ADR. It takes into account the general regulation under the Administrative Procedure Act and the Administrative Disputes Act, as well as examples from sector-specific legislation and practice. On the basis thereof, it systematically discusses the limitations and the potential of ADR and the dogmatics of the forms de lege lata and de lege ferenda. The author concludes that in administrative relations, ADR should be understood otherwise than e.g. in litigation, but the benefits of such approach – provided that corrective mechanisms against malpractice are introduced in the existing administrative and judicial procedures – outweigh the existing formalisation. ADR is thus seen as an excellent tool for developing good administration.

    Protection of the Locational Privacy Using Mosaic Theory of DataVarstvo lokacijske zasebnosti s pomočjo mozaične teorije podatkov

    Synopsis:
    The individual’s right to privacy is one of the fundamental human rights. Part of this »embedded« right presents a person’s capability to move from a variety of different points and locations with reasonable expectation that performed paths, stops and current locations are not systematically recorded and stored for future use. Notwithstanding this, individuals often seem to be ignorant of the modern technology capabilities, which is aggressively interfering with wide spectrum of their privacy, part of which is also locational privacy. However, the following as one of the existential component of privacy must also be given all the necessary legal protection, which, at least for the time being, is reflected in the implementation of the mosaic theory in the European legal traditions with the help of established legal standards of the European Court of Human Rights regarding privacy.

    On Libertarianism and the Proprietary Understanding of Human Rights

    O libertarizmu in lastninskem pojmovanju človekovih pravic


    Synopsis:
    The article deals with the theory of libertarianism which is clearly distinguished from the theory of liberalism and tries to answer the question of what exactly is “a libertarian understanding” of human rights. The author, already in the article’s title, offers an answer in a form of the “proprietary” understanding and through the text confronts the reader with the reasoning behind such an understanding. He points out several elements of the substantive and formal transformation of the traditional notion of human rights and basic freedoms needed for the notion to be coherent with the theory of libertarianism. The author understands the traditional function of human rights as a protective mechanism for the individual against the state and presents the libertarian understanding of the notion as a result of the libertarian understanding of one’s personal freedom that is based on the principle of self-ownership and the nonaggression principle by which every encroachment with one’s property (extending to his own body and will) has to derive from a consensus among (two) parties. Thereby human rights need to put on a new role in which they are completely dependent on the right to property (being the only natural and superior right) and function in a negative, relative and value-neutral manner.

    Collective Wisdom – A New form of Participation in the Management of Public Affairs

    Kolektivna modrost – nova oblika sodelovanja ljudstva pri upravljanju javnih zadev


    Synopsis:
    Collective wisdom should be put at the forefront of state management due to its operation in a direction of more impartial and professional information, as individual experts could give them. If a representative sample can give us a sufficient security not only as presumptions, but also for actions towards the conclusions from a joint consultation, this presents a new view on the management of public affairs. If the rules of prediction were associated with this method of obtaining data, their results would give more objectivity and flexibility of legal norms to real situations. By this way, a public system of collective wisdom would be established which could in complicated cases surpass the present, still largely hierarchical and indirect forms of democratic governance that rely primarily on intuition and expert opinions.

    “Pay for Delay” – A Subtly Hidden, Overlooked or Ignored Transatlantic Divide: Exemplified on the Actavis decision of the US Supreme Court and the Servier decision of the EU Commission

    Synopsis:
    The relationship between antitrust law and intellectual property rights, as exclusive rights, i.e. legal monopolies, has always been characterized by a mutual distrust of protagonists of either discipline. Only more recently the understanding started to prevail that intellectual property and antitrust laws work in tandem to bring new and better technologies, products and services to consumers at lower prices. The judicial treatment of the so-called “pay for delay” patent settlement agreements by courts and antitrust authorities, however, demonstrates how complicate and problem-burdened the application of antitrust law on legal transactions at the crossroads of antitrust law and patent law is and how difficult it is to achieve well balanced solutions satisfying the goals of both disciplines. In this contribution the legal situation under the US law, as applied by the US Supreme Court in the Actavis case, and under the EU law, as applied by the EU Commission in the Servier case is examined and the differences elaborated by taking into account the relevant facts of each case. The approach of the EU Commission is, eventually, critically reviewed in the light of the recent interpretation of Article 101 of the Treaty on the Functioning of the European Union by the Court of Justice of the European Union in the Groupement des Cartes Bancaires case.

    The Elements of Punitive Damages in Slovenian LawElementi kaznovalne odškodnine v slovenskem pravnem redu


    Synopsis:
    The institute of punitive damages is controversial in continental as well as in Anglo-Saxon legal environment. It can be defined as monetary compensation awarded to an injured party that goes beyond the amount, necessary to compensate the individual for losses and that is intended to punish the wrongdoer. The article analyses slovenian law and tries to shed a light on parts of slovene legal system which pursue the goals of prevention, deterrence and punishment as principle goals of punitive damages. The above mentioned analysis leads to a conclusion that punishment of the wrongdoer is not accepted in slovenian legal environment, at least not to the point equivalent to restitution and satisfaction.

      The Authorship of a Musical Work and the Position of a Music Arranger

      Avtorstvo glasbenega dela in položaj glasbenega aranžerja

      Synopsis:
      The creation of the final form of a piece of popular music usually involves several people: the composer, the lyricist, the music arranger, performers, sound engineers, etc. The article explores under what conditions the contributions of these persons constitute co-authorship of a piece of music and discusses in which phase a musical work can be considered finished. The copyright status of a music arranger is discussed in particular, whose work is usually defined in theory as adaptation of existing musical works, whereas in the practice of Slovenian popular music, arrangers often act as co-authors of new original music. The last part of the article examines the rules on the duration of rights in musical works produced in co-authorship and discusses in what way the ownership and the duration of copyrights in musical works is affected by Directive 2011/77/EU, which sets out unified rules on the duration of rights in musical compositions with words.

      Competition Law and the Energy Sector

      Konkurenčno pravo in energetski sektor

      Synopsis:
      The paper deals with the influence and place of competition law in the energy sector. Since energy is considered an economic sector, which is regulated, it also touches the phenomenon of regulation itself, as well as the liberalization. In terms of content it is divided into two parts. The first set is of general and introductory character. It deals with regulation, liberalization and competition law from conceptual aspects and tackles the relationship between rules that constitute sectoral regulation and legislation in the field of competition law. The different packages liberalization in the EU, especially the sectoral report in 2007 are dealt with, as well. The second part goes deeper into the analysis of recent cases in the field of competition law in the EU. It deals with agreements which restrict competition, abuse of dominant position. In particular, it analyses the long-term supply contracts and all steps for their assessment, as well as the competitive problems of public undertakings and undertakings with exclusive rights, and the latest anti-competitive practices.

      Why do People Stop offending? Recent Theories on Desistance and Their Value in Practical Approaches to offenders

      Synopsis:
      Desistance theories, researching the ways how and reasons why people stop offending have developed only recently. The article briefly describe their development in general and then examines four of the more recent influential ones in more detail: Laub and Sampson’s Age-graded theory of social control, the Cognitive transformation theory developed by Giordano et al., Maruna’s Theory of narrative self-change and Wikström’s Situational action theory. These theories are analysed with regard to their applicability to general or specific offending populations. Finally, the sociotherapeutic approach common to the Slovenian system in the past is analysed through the lenses of these theories and conclusions as to the value of general and specific theories and approaches are made.

      Imago iudicis, Four Images from the History of Ideas on Judging

      Imago iudicis, štiri podobe iz idejne zgodovine sojenja

      Synopsis:
      The article traces the developing image of a judge in Western legal thought. It starts with the famous Montesquieu’s characterisation of a judge as “the mouth that pronounces the words of the law”. Despite our common intuition (that he was describing a Continental judge), he was, the author argues, in fact offering his best understanding of an English judge. His portrayal has to a large extent corresponded with the self-understanding an English judge of that time (and long afterwards) surely held. Gradually, Montesquieu’s image of a judge became synonymous with formalistic approach to judging, triggering a backlash. The German Free Law Movement is perhaps the most influential embodiment of such a reaction. Arguing for the recognition of a creative aspect of judging, they relied on their understanding of a common law judge, which was then still at odds with the official self-image cultivated by English judges. In the next decades, the same disillusion with a mechanistic image of judging prevalent also in the United States gave rise to American Legal Realism. The Realists adopted the Free Law Movement agenda to an important extent, part and parcel with the conviction that judicial creativity is an innate characteristic of a judge’s role. It is this conviction that still occupies the centre of all modern theories on judicial decision-making.

      Substantive Legality in the Determination of Tax Liabilities in Terms of Time Validity

      Materialna zakonitost pri določanju davčnih obveznostih z vidika časovne veljavnosti

      Synopsis:
      In the article the author deals with the question which substantive tax rules that determine a taxpayer and tax liability (tax debt) should apply in cases where these rules change from the time a taxable event takes place and until the tax is self-assessed of levied, if the legislator has not prescribed anything in the transitional provisions in this respect. Since the Slovenian tax legislation has no general provisions for such cases, the jurisprudence has decided to either apply the provisions that were in force at the date that tax obligation occurred or provisions that were in force during the tax period to which the tax liability relates. The author is a bit critical of that position because he finds it inadequate to some extent. Therefore he suggests an amended interpretation which takes into account provisions of the Slovenian constitution and practice of the Slovenian Constitutional Court. In conclusion, the author proposes an amendment of the Slovenian tax legislation with the enactment of a general provision that would resolve such legal situations.

      The Agreement on Succession Issues and Some Dilemmas Regarding Its Implementation

      Synopsis:
      The Agreement on Succession Issues was concluded only ten years after the break-up of Yugoslavia and was at the time considered a great political success as it was the first treaty concluded between all of the successor states to the former SFRY. The international community has affirmed its contribution to peace and stability in the region. It regulates almost all succession issues, namely movable and immovable state property, including diplomatic and consular properties, financial assets and liabilities, state archives, other rights and interests, pensions and acquired rights. This article analyses the Agreement in the light of its implementation and highlights important issues that are still to be settled among the successor states in order to bring this process to an end, bearing in mind the consequences for bilateral relations among states and regional cooperation if its full implementation fails. Legal issues are discussed, as well as the political environment, which affects the implementation.

      Structural Changes in Slovenian Criminal Procedure over the Last 20 Years

      Strukturne spremembe slovenskega kazenskega procesnega prava v zadnjih dvajsetih letih

      Synopsis:
      The author analyses changes to Slovenian criminal procedure between 1994, when the first Slovenian code was adopted on the basis of the last consistent Yugoslavian model (enacted in 1967) to the present day. Thirteen amendments have already been made to the Code since 1994, and the author argues that it is the role of public prosecutor which has changed the most in this period: prosecutors are slowly but surely becoming the dominus litis of pre-trial procedure, thereby pushing the investigating judge ever further towards the role of a pre-trial judge and away from that of an inquisitorial investigator. This trend has been accompanied by a tendency to abolish the phase of judicial investigation completely and to introduce a unitary preliminary phase of criminal procedure led by the prosecutor. The basic principle of Slovenian procedure is still the so-called inquisitorial maxim, which therefore places it among other European inquisitorial systems, but gradually more adversarial solutions are being incorporated. Key examples of this trend are: the solution granting the suspect the right to be acquainted with his rights in the moment when the investigation becomes focused on him/her; in the introduction of selection mechanisms; in the adversarial model of a decision-making process of ordering investigating and coercive measures and consequently in the stronger activation of both parties at an earlier stage. The peak of this trend can be found in the introduction of plea negotiations. Increasingly, we see the adoption of legal solutions which put the defendant and the prosecutor in ever more active roles, making them more autonomous subjects with the power to resolve cases quicker than before, while the court becomes more passive, shrinking to the much more limited role of controlling their agreements.

      Protection Acts for Slovenian Linguistic Minority in Italy and the Municipality of Resia: Minority Rights between Law and Politics

      Synopsis:
      Resia is a part of Slovenian ethnic settlement in Italy, yet due to geographical and historical reasons, most of the population has not developed a sense of Slovenian ethnic identity, but rather, only their local one. After 1999 the municipality of Resia was included into three protection acts for Slovenian linguistic minority. Part of the population and the actual municipal government is categorically opposed to that, which has provoked many drastic conflicts in the valley. In this paper, the author presents and analyses the placement of the municipality of Resia into the protection acts for Slovenian minority, reasons for opposing this placement and the problems with the application of the minority protection by the authorities.

      Arms Trafficking: Aiding and Abetting Core Crimes

      Synopsis:
      The provision of arms for the commission of crimes is one of the typical forms of aiding and abetting. This article discusses arms trafficking as a form of aiding and abetting the commission of core crimes. It opens with a discussion of aiding and abetting as a form of complicity in the Rome Statute and the case law of the International Criminal Court. Furthermore, the article also analyses the regulation of legal arms trafficking in international and European law. Accordingly, the international criminal law further regulates illegal arms trafficking as an international crime and as complicity to core crimes. Therefore, the article first presents arms trafficking as an international crime and subsequently discusses arms trafficking as complicity in core crimes. The article concludes with a discussion on the regulation of arms trafficking in Slovene law, beginning with legal arms trafficking according to the Firearms Act-1 and ending with illegal arms trafficking as a crime.

      Financial Transaction Tax

      Davek na finančne transakcije

      Synopsis: Financial transaction tax has been proposed already by Keynes; however it has been introduced only in some individual countries and not globally, which would reduce possibilities for tax evasion. Nevertheless, the topic gained importance during the recent financial crisis – the tax is supposed to reduce risky activities of the financial industry and fill the budgets with the means for alleviating the consequences of the crisis, largely caused by the financial industry. Proposal of the European Commission is therefore the first concrete proposal that addresses a wider economic area. This paper investigates economic, theoretical rationale for the introduction of a financial transaction tax and studies its structure and consequences in several European countries: United Kingdom, France, Italy and Sweden. Special emphasis is given to the proposal of the European Commission that would, in case it is confirmed, apply also to Slovenia, although some concerns have arisen recently, weather Slovenia should introduce the tax or not.

      The little Grey Cells and the large Grey areas: The Brain as the Source of Evidence in Criminal law

      Male sive celice in velika siva polja: možgani kot dokazni vir v kazenskem pravu

      Synopsis: The increasing use of neuroscience-based evidence in criminal courts raises many questions in evidentiary criminal law. The first grey area is connected to the limited probative value of such material that is intertwined with the numerous limitations of modern methods of neuroimaging and their speculative nature. The use of structural brain images in criminal procedure can be considered admissible in Slovenian law, despite the deep intrusion into one’s privacy. The accused and the witness can be subjected to the neuroimaging procedure even against their will. However, the opposite can be said about approaches that use neuroscience as an interrogation tool. Due to the privilege against self-incrimination and the ban of the use of medical interventions and agents, such methods are deemed inadmissible in criminal procedure, since they gain testimonial evidence by circumventing the interrogated person’s will to testify.

      Constitutional Restrictions and Prohibitions of the legislative Referendum

      Ustavne omejitve in prepovedi zakonodajnega referenduma

      Synopsis: With the amendment of article 90 of the Constitution of the Republic of Slovenia, following the model of comparable European states, Slovenia too introduced restrictions and prohibitions on the legislative referendum. A legislative referendum can no longer be called for laws pertaining to emergency measures to ensure the defence of the state, security, or the elimination of the consequences of natural disasters; financial and budgetary laws as well as the law adopted for the implementation of the state budget; laws ratifying international treaties; and laws eliminating unconstitutionality in the field of human rights and fundamental freedoms or any other unconstitutionality. Delaying the adoption of such laws, and their rejection in a referendum in particular, would represent a serious hindrance for the functioning of the state and the execution of its fundamental functions – especially in adopting urgent legislative measures. Restrictions and prohibitions of referendum decision-making are characteristic of those systems where the referendum may be demanded by the voters. In systems where the referendum is in the hands of the parliamentary majority, the need for express prohibitions is considerably smaller, if not redundant, since the parliament independently decides on the appropriateness of a referendum decision-making on such laws.

      The Development of Provisional Measures in European Civil Procedural law

At the level of the European Union this field has been subject to the regulation for many years, the latest one could be found in Regulation (EU) No. 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, which shall apply from 10 January 2015. With the overview of major changes the article tries to show the development of the subject and its influence on the positions of the creditors and debtors.

      Privacy After Snowden: Theoretical Developments and Public Opinion Perceptions of Privacy in Slovenia

      Zasebnost po Snowdnu: novejša pojmovanja zasebnosti in odnos javnosti do le-te v Sloveniji

      Synopsis: The article analyses recent theorizing of privacy arising from new technologies that allow constant and ubiquitous monitoring of our communication and movement. The theoretical part analyses Helen Nissenbaum’s theory of contextual integrity of privacy and pluralistic understanding of privacy by Daniel Solove. The empirical part presents the results of an online survey on the Slovenian public perceptions of privacy that includes questions on types and frequency of victimizations relating to the right to privacy; self-reported privacy violations; concern for the protection of one’s own privacy; perception of primary privacy offenders; the value of privacy; attitude towards data retention in public telecommunication networks; and acquaintance with the Information Commissioner of RS. Despite growing distrust of large internet corporations and – after Edward Snowden’s revelations – Intelligence agencies, the findings indicate a low degree of awareness and care for the protection of personal data.

      Quis Custodiet Ipsos Custodes: Protection of Human Rights at the International Criminal Court

      Quis custodiet ipsos custodes: zaščita človekovih pravic v postopku pred Mednarodnim kazenskim sodiščem

      Synopsis:

      International criminal law has been long focusing on providing criminal responsibility to perpetrators of international crimes and preventing their impunity, but it also has to provide fair trial at the same time. In connection to this an issue arises, whether the legality of the procedure has to be ensured by external supervision. That became especially relevant with the establishment of a permanent International Criminal Court (the ICC). This paper therefore tries to verify the hypothesis that the Rome Statute includes all the regular mechanisms for protection of the defendant’s rights, but the external supervision is still required. The paper firstly discussed the existing possibility of protection of the defendant’s rights in the ICC − means of invoking or sanctioning violations of these rights through legal remedies, criminal, civil and tort liability or inadmissibility of evidence. Second part of the paper includes thoughts on possibility of the ICC joining the existing universal, regional or national supervisory mechanisms.

      Recognition and Enforcement of Domestic and Foreign Arbitral Awards in Slovenia

      Priznanje in izvršitev domačih in tujih arbitražnih odločb v Sloveniji

      Synopsis:
      With the introduction of mandatory exequatur procedure, the new Slovenian Arbitration act has substantially reformed the system of enforcement of domestic arbitral awards. Also provisions concerning enforcement of protective and interim measures, adopted in domestic and foreign arbitrations are new. In regard to recognition and enforcement of foreign arbitral awards, the changes are not so substantial, since the New York Convention has been in force in Slovenia already before. The author discusses the grounds for refusal of exequatur as well as the procedural issues. Thereby it is assessed – not only in view of the statutory regulation but foremost in the view of the existing case­law whether Slovenia is an »arbitration friendly« jurisdiction.

      A Gloss about the Case of »47 Teddy Bears« in Connection to the Serious Crime of Business Fraud and Overcriminalization of de Minimis Cases of Economic Crime

      Glosa o »47 medotih« h kaznivemu dejanju poslovne goljufije in širjenju cone kriminalnosti v gospodarsko bagatelo

      Synopsis:
      Overcriminalization is often criticised, however the criticism in academic discussions is mainly »grounded« on the value based principle of criminal law as the ultima ratio or the last resort. The usual abstract methodology is turned upside down in this paper which aims to shed light on the problem at hand by analysing the case of »47 Teddy bears«. The case or rather cases involve a limited liability company »Teddy bear Ltd.« which filed (at least) 47 individual criminal complaints for the serious crime of business fraud against its debtors for non­payment of goods delivered. Even though we are dealing with practically identical facts and formulaic wording of the criminal complaints in most of the 47 cases, they did not all end the same way. In some of the cases, the prosecutor dismissed the complaint prima facie, in some the case was dropped in the investigative phase of the criminal procedure, some cases ended in acquittals and there are even cases where the debtors were found guilty of business fraud. Based on a larger sample of 562 cases of business fraud which were analysed, the author concluded that the case of the »47 Teddy bears« is a paradigmatic case of how criminal law is (ab)used in practice by creditors who use it to transfer their private debt collection costs on the state, specifically its criminal law system. The volume of such business fraud cases has another negative effect in the sense that it »steals« valuable resources from the criminal law system which could otherwise have been used to tackle more insidious and dangerous cases of economic crime. The analysis also indicates that prosecutors and judges have at their disposal enough interpretative discretion to clear de minimis cases of their dockets, if they want to.

      International Obligations of States for Sustainable Development of Forests

      Mednarodne obveznosti držav za zagotavljanje trajnostnega razvoja gozdov

      Synopsis:
      Widely recognized definition of sustainable development, adopted by the World Commission on Environment and Development, defines sustainable development as development that meets the needs of the present generations without compromising the ability of future generations to meet their own needs. Due to its important role of interconnecting the three pillars of environment, economic growth and social rights, all relevant for the future of our society as a whole, a new field of international environmental law is evolving, namely international law of sustainable development. Following the analysis of international documents, this paper presents the international obligations of states for sustainable development and mirrors those to the specific commitment of sustainable development of forests.

      From the Judiciary to the Prosecution? The Impact of Plea Bargaining on Sentencing

      Iz sodnikovih v tožilčeve roke? Vpliv pogajanj o sankcijah na kaznovanje

      Synopsis:
      Plea bargaining is an alien in continental criminal procedures and brings about plenty of important issues. The discussion in this article revolves around such issues as they relate to the questions of punishment and sentencing. Two main notions are dealt with in this respect: First, I examine the relationship between plea bargaining and one of the cornerstone principles of punishment in continental systems – the individualisation of punishment. Secondly, the wider question regarding the changing role of the prosecution is addressed, mainly from the viewpoint of shifting responsibility and authority with regard to sentencing from the judiciary to the prosecution.

      Regulatory interlocutory injunction

      Synopsis:
      Before the decision of the Constitutional Court of the Republic of Slovenia No. Up-275/97, the only purpose of interlocutory injunctions was to protect future enforcement (so called security interlocutory injunctions). To protect an effectiveness of constitutional right to judicial protection the Constitutional court allowed interlocutory injunctions regulating a legal relationship that is in dispute even during the court proceeding and therefore prior to the final judgment (so called regulatory interlocutory injunctions). But a possibility of issuing these without their normative regulation induced in case-law a lot of questions. The article tries to answer some of them with studying relevant case-law and legal theory.

      Comparing the Strengths and Weaknesses of Electoral Systems

      Primerjava prednosti in slabosti volilnih sistemov

      Synopsis:
      The author compares three electoral systems with each other and with the current Slovenian electoral system. The strengths and weaknesses of the absolute (two-round) majority system, the proportional electoral system with a preferential vote and the mixed-member proportional system are also discussed in light of the current political and economic crisis in Slovenia. The majority system, on the one hand, ensures greater stability of the government but lacks proper (majoritarian) legitimacy. It is thus unacceptable in terms of the present economic crisis in which the government needs convincing legitimacy as well as because of its inherent quality of polarizing the political landscape. On the other hand, the lack of influence of the voters on which candidates will be elected (personalization) in proportional system, is particularly inappropriate in light of the serious discontent of the protesters with the current lack of political legitimacy of the political parties. Therefore, the author favors the introduction of the combined electoral system which combines the strengths of both previous systems.

      Effects of Contemporary Technologies on Crime and Criminal Investigations

      Nove tehnologije in njihov vpliv na pojavnost in pregon kriminalitete

      Synopsis:
      The article analyses the effects of certain contemporary new technologies on crime and criminal investigation, taking into account how data gathered by these technologies being deployed for preventative purposes often becomes evidence for criminal procedure. Special attention is given to measures which all potentially breach the right to privacy: measures to investigate cybercrime, measures introduced on the basis of the doctrine of ‘special needs’, roving wiretaps, data-mining and the use of so-called protective technologies. Given the greater scope such technologies provide for avoiding certain classical criminal procedure safeguards, the state must take special care to guarantee a balance of conflicting rights by providing strict judicial control of such overextended, general and preventive measures and strict exclusion of the evidence thus gathered.

      Cyberbullying: Concept, Types, Consequences and Criminal Law Response

      Spletno in mobilno nadlegovanje: pojem, oblike, posledice in soočanje s kazenskim pravom

      Synopsis:
      The article analyses cyberbullying and its multifaceted nature that refers to bullying and harassment of others by means of new electronic technologies, primarily mobile phones and the Internet. It presents consequences and dangers of cyberbullying and continues by focusing on possible avenues of interventions against cyberbullying, specifically on disciplinary rules within educational setting, specifically primary schools, and criminal law. It analyses new characteristics of cyberbullying, such as anonymity of perpetrator, greater scale of audience and its boundless nature crossing existing time-space borders that are turning cyberbullying into new type of deviance. It concludes by focusing on avenues of criminal prosecution of cyberbullies under Slovenian Criminal Code and proposes its changes de lege ferenda.

      Application of Merger of Offences in Current Case Law of International Criminal Court

      Steki med mednarodnimi hudodelstvi v sodni praksi mednarodnega kazenskega sodišča

      Synopsis:
      The main focus of this paper is on the case law of the ICC on the merger of offences, especially in regard to the relationship between different international crimes with the same physical act. The case law of ICC is critically analysed and compared to the case law of the International Court for the Former Yugoslavia (ICTY) and Ruanda (ICTR). The current case law of the ICC follows the case law of the ICTY and ICTR and focuses on the relationship between different international crimes. When the crimes against humanity and war crimes for example have the same act, they are both prosecuted, even though they are based on the same actual situation. Even though in my opinion according to its lex specialis nature only the worst international crime should be prosecuted. On the other hand, only one case of each international crime is prosecuted as a sample to the pattern of the perpetrator’s behaviour despite its personal nature and different victims.

        State and Sovereignty in the Era of Globalisation: Role of Regional Economic Integrations with Special Emphasis on the European Union

        Synopsis:
        The concept of economic sovereignty has become increasingly important in the last decades. It is viewed as the ability of state to promote growth and development by using monetary, fiscal, trading and industrial policy while at the same time taking into consideration the exogenous factors (world market conditions, etc). By joining different types of regional economic integrations (REI) states give up some components of their economic sovereignty and transfer them to REI in order to promote economic development and growth. The aim of this article is to identify different parts of economic sovereignty which are lost or being limited by membership in different types of REI. Cases of European Union and euro area are being analysed in detail.

        The limits of aiding and abetting in Criminal law

        Pomoč in njene meje v kazenskem pravu 

        Synopsis:
        The article analyses aiding and abetting as a form of participation in criminal law. Firstly, the attention is paid to the time-limits of aiding and abetting, which, according to the author, have to be defined narrowly, and must not be stretched over the formal completion of the act. Another crucial question is delimitation of aiding and abetting and co-perpetration. The author argues that aiding and abetting can be, however, it must not be a necessary precondition for success of the act. In this respect he critically analyses some judicial decisions in which typical acts of aiding and abetting are held for co-perpetration, since they are deemed as necessary precondition for the criminal offence. Finally, the article addresses sentencing, where the author pleads for obligatory reduction of punishment in cases of aiding and abetting.

        The Defendant's Capacity to Stand Trial in Criminal Procedure

        Razpravna sposobnost obdolženca v kazenskem postopku 

        Synopsis:
        The issue of the defendant's capacity to stand trial has long been neglected in the Slovenian law of criminal procedure. Although courts regularly decide on this issue, the rules are far from clear, given the lack of statutory basis and a lack of a systematic theoretical analysis. This paper attempts to fill the latter void by analysing rules on the capacity to stand trial from a comparative perspective, using theory and relevant case-law.

        (Development) of the Relationship between the Fundamental Rights and Economic Freedoms and Competition Rules in EU law

        (Razvoj) razmerja med temeljnimi pravicami in svoboščinami ter temeljnimi ekonomskimi svoboščinami ter pravili o konkurenci v pravu EU 

        Synopsis:
        The article discusses the development of the relationship between fundamental rights and freedoms and fundamental economic freedoms and competition rules in the community law. In this context the development and recent changes in the primary competition law are analysed as well. Primary sources of community law have not been significantly changed in and since the Lisbon documents. The central question remains the impact of human rights on interpretation and the use of economic freedoms. The analysis starts with the first period with the focus on economic component. The central part of the article is the analysis of decisions in which human rights influenced importantly on the economic freedom; the analysis is based on judgments in ERT via Connolly and Schmidberger to Omega. Finally decisions post­Omega since 2005 are dealt with.

        Sources of International Criminal law

        Viri mednarodnega kazenskega prava 

        Synopsis:
        International criminal law (ICL) is a relatively new legal discipline which is in the view of the authoress closely related to public international law. The underlying reason for this assumption lies in the fact that three inherent international criminal courts are functioning in the international community, namely the two ad hoc tribunals for former Yugoslavia (ICTY) and Rwanda (ICTR) and the International Criminal Court (ICC). The case–law of these courts proves that international law as part of ICL prevails in their proceedings. Therefore Article 38 (I) of the International Court of Justice has been used as a starting point to analyze the sources of ICL. Although this provision is helpful as far as it concerns the categorization of the main sources (treaties, rules of customary international law, general principles of law) and the subsidiary ones (case–law, legal theory), it has its deficiencies when applied in the ICL. Namely, the main preoccupation of the ICL is the criminal accountability of individuals for the most heinous crimes. Therefore, the principle of legality must prevail in the ICL. One of the shortcomings of the Statutes of the ICTY and ICTR is the absence of the rule on sources. This was overcome by the Rome Statute of the ICC which contains the provision on applicable law in Article 21.

        A New Conception of Economic Dependence as a Possible Factor in Personal Scope of Labour Law

        Nova koncepcija ekonomske odvisnosti kot možen dejavnik osebne veljavnosti delovnega prava 

        Synopsis:
        The author wishes to first clearly define the concept of economic dependence as understood by the more recent theory of labour law and the ILO. He therefore appropriately allocates the notion of economic dependence to the theoretical employment relationship concept and distinguishes it from it. The author then deals with many legal and theoretical questions regarding the role of national legislation regarding economic dependence, highlighting the possibility that economic dependency is regarded as an independent definable element of an employment relationship and the possibility that economic dependency is recognised merely as a factor ensuring the labour law protection. After a detailed analysis of possible solutions and impacts, the author finds the second method to be more appropriate, at least for the Slovenian system of labour legislation.

        Introducing  Plea  Bargaining  to  Slovenian  Criminal  Procedure: Selected Issues

        Nekateri pomisleki ob uvajanju pogajanj o priznanju krivde v slovenski kazenski postopek 

        Synopsis:
        One of the main features of the latest proposed amendment to the Slovenian Code of Criminal Procedure is the introduction of plea bargaining where the prosecutor offers to the defendant a reduced sentence in exchange of his guilty plea. Even though plea bargaining brings obvious advantages to the criminal procedure (the defendant is punished leniently, prosecutor assures the conviction, whereas the court is disburdened of numerous criminal cases and lastly, the elimination of backlog of court cases has benefits for the general public), there are also serious doubts about this method as a proper and just way of solving criminal cases. The article describes some legal, psychological and sociological concerns and the conclusion is reached that without the change of philosophical foundation of Slovenian criminal procedure (from state-oriented crime prosecution to consensual way of solving criminal cases) and unless these concerns are adequately addressed, a serious doubt that plea bargaining is appropriate way of solving criminal cases will remain.

        Economic and legal aspects of on-line Gambling – why Monopoly might be better than Competition

        Ekonomski in pravni pogled na prirejanje spletnih iger na srečo – zakaj je monopol lahko boljši kot prosti trg 

        Synopsis:
        Together with the development of technology, the on-line gambling expanded all over the world, together with hunger for income and unfortunate appearance of negative effects connected with gambling – negative externalities. With high incomes and big negative externalities the question arises whether or not and to what extent the regulation of internet gambling is beneficial. The article first discusses EU and Slovenian regulation of internet gambling by discussing the European Court of Justice cases in the gambling field and the adherence of Slovenian regulation to the ECJ decisions. The second part of the article examines the economic rationale of ECJ gambling decisions and concludes that the ECJ decisions make economic sense, since they intend to increase the welfare in society. The article concludes that the monopoly in the internet gambling sector might be more beneficial for the economy than the competition.

        The Defence of Superior order in International Criminal law

        Odgovornost za mednarodno hudodelstvo, izvršeno na ukaz nadrejenega 

        Synopsis:
        International criminal law has developed different responses to dilemma of superior order (the theory of absolute liability, respondeat superior, act of state doctrine, mens rea theory, or theory of limited liability). The proposed upgraded mens rea theory claims that the superior order can be used only as the factual basis for the determination of other defences; mistake, necessity and duress. One argument for this theory is that none of the other theories is complete. They do not cover all the facts of the potential cases. A mistake of law remains relevant, but according to its general rules. The same applies for the use of rules of necessity or duress. However, a very important question is, whether this theory can be applied at the international legal level. In national systems defences have been developed and there is no problem. At the international level, however, the general part of international criminal law has been neglected and left to the practice courts until recently.
